A Blighted Terrace House Is Everybody's Problem

The statutory test for blighted property is a structure that endangers the public's health, safety or welfare because it is dilapidated, deteriorated or violates minimum health and safety standards.

In a row of attached houses that test is easier to satisfy and more likely to be raised, because a damaged building with open walls or an unsupported party wall genuinely does affect the people either side of it. Does That Make a Notice More Likely?

It makes a complaint more likely, which is frequently how a property comes to a locality's attention in the first place. It also means that a plan which addresses the neighbours' position, by dealing with the shared wall and making the structure safe, is doing more of the statutory work than a plan which only addresses your own interior. Worth reflecting that in what you file.

The Shared Wall Is a Technical Problem Too

Where a fire has affected a party wall, the building next door is structurally involved whether or not it burned. Repairs have to be coordinated, insurers on both sides may be engaged, and neither owner can simply proceed independently.

That lengthens a programme and it makes early conversation with the neighbour worth far more than it costs. Files where both positions are understood move; files where neither owner has spoken to the other stall.

What If the Neighbour Will Not Engage?

Then you are dealing with a property and person question rather than a construction one, and it is worth advice. What matters for this statute is that your own written plan can only commit to what you control, and saying so explicitly is better than a plan that quietly assumes cooperation you do not have.

The Provisions That Reach a Terrace

Section 36-3 defines blighted property as a structure endangering the public's health, safety or welfare through dilapidation or deterioration. Section 36-49.1:1 gives the owner 30 days to respond in writing.

Subsection G allows a locality to declare the property a nuisance and abate it under sections 15.2-900 or 15.2-1115, with costs becoming a lien bearing interest under section 6.2-301.

First enacted in 1994 and revised in 1995, 1996, 1997, 1998, 1999, 2001 and 2003, the section has retained its 30 day response period throughout.
